This website is operated by Hilary’s Patch. Where these terms and conditions use terms such as “we”, “us” and “our” they refer to Hilary’s Patch.
We reserve the right to update, change or replace any part of these terms and conditions, without prior notice to you, by posting updates on this page. It is your responsibility to check this page on each visit to your website, read these terms and conditions and ensure you understand them before making a purchase.
You are entitled to cancel your order and return the goods within 14 days after receipt for a full refund or exchange, provided that:
i) The goods are returned in the same condition they were sold;
ii) The goods are a normal stock item;
iii) The goods are returned by a tracked method i.e. Recorded Delivery. You are responsible for the cost and risk of loss or damage when returning the goods, so you should take out enough postal insurance to cover their value.
Please note: Unless faulty, the following types of items are non-refundable: items that are personalised, bespoke or made-to-order to your specific requirements.

Your rights to return goods are protected under the EU Distance Selling Directive which can be found here.
This cancellation policy does not affect your rights when we are at fault – for example, if goods are faulty or mis-described.
These terms apply to your order, however, we reserve the right to change our terms and conditions at any time.
None of these terms affect your legal rights which are not diminished in any way. If any term is held to be invalid under any applicable statute or rule of law, that term is automatically omitted from the terms to minimum extent necessary to comply with the law and without affecting the validity or enforceability of the remainder.
To be eligible for a return, your item must be unused and in the same condition that you received it, and it must be in the original packaging. Kits should be unused and all materials must still be intact.
Some types of goods are exempt from being returned for a refund.
Other types of services cannot be returned for a refund, for example where the service begins as soon as you make the payment (e.g. a downloadable software product).
Under the Consumer Contracts Regulations, if you change your mind about a purchase you have made (i.e. the goods or services provided are not faulty) within 14 working days after the date of delivery, you are entitled to a full refund of the original purchase price for the goods or services you wish to return, not including the original postage and packaging charges made. You will not be entitled to a refund of the cost you incur in returning the item to us.
If the item you purchased was faulty or you think the item was not as described in the item description, please contact us first before requesting a refund as we may be able to resolve your problem to your satisfaction.
If the item you purchased was faulty or did not work properly and you would like a refund or exchange, you are entitled to a full refund of the original purchase price for the goods or services you wish to return, including the original postage and packaging charges made. Alternatively you may wish to exchange your items. We will refund the cost incurred in returning the items to us in the event of a faulty product. PLEASE NOTE the following types of items are non-refundable: items that are personalised, bespoke or made-to-order to your specific requirements.

Where you would like to return a physical product you have purchased, please contact us to let us know that you will be returning the item. For your own protection, you are strongly advised to obtain a proof of posting when returning goods whatever the reason for the return. Goods which are returned to us but are lost in transit remain your responsibility. A proof of posting will assist you in tracking any return which is reported as lost, damaged, mislaid or otherwise undelivered/undeliverable.
To obtain a refund for a non-physical product (like a downloadable chart) please contact us.
Once your return is received and inspected we’ll contact you to let you know whether your refund will be processed or not, and credit your original method of payment.
If an item you purchased was purchased with a discount voucher, then we will only refund the amount that you paid (and not the amount the item was listed for).
If an item you purchased was in a sale then it may not be eligible for a refund if you have changed your mind. If you are in any doubt please contact us before making the purchase.
ONLINE STORE TERMS
We will take all reasonable care to ensure that the details displayed for a particular item offered for sale are correct at the time when the information was listed.
Whilst care is taken to ensure that we display as accurately as possible appearances, colours, textures or finishes, what you will see on your computer monitor or equipment may differ and so we cannot guarantee that images are an accurate representation of the actual goods or services that you are purchasing.
We may not be able to accept your order due to one or more of the following reasons, or for a reason not listed below:
i) The item you have ordered is out of stock
ii) We cannot authorise your payment or have reasonable grounds to suspect your payment may be fraudulent
iii) There has been a pricing or product description error
iv) There is a system or procurement failure
v) You have failed our customer validation checks
No order is binding on you or Hilary’s Patch until we have accepted it. You will own the items we supply you from the moment they are put in the hands of the postal service, or on payment in full of the price of the items and any delivery charge, whichever is later.
Your order is processed via PayPal. No credit card details are stored by us on this site (please see Data Protection policy below).
MODIFICATIONS TO OUR SERVICE AND PRICING
Prices for items are subject to change without notice.
We reserve the right, at any time, to modify or discontinue any part of the service that we offer, or any part of content thereof, without any notice to you.
We accept no liability to you or to any third-party for any modification, price change, suspension or discontinuation of the service.
Every effort is made to ensure that all the information provided on the Hilary’s Patch website is correct. If we discover an error relating to your order, we will contact you as soon as possible to advise you of the error and confirm that you still wish to proceed.
LIABILITY AND INDEMNITY
We shall not be liable for any direct, special, indirect or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any items that have been ordered on this website.
You agree to indemnify us and our agents, officers, directors and employees, immediately and on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of any of our terms and conditions.
These terms and conditions shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the courts of England & Wales.
Should any part-term or term be found to be unenforceable then the remainder of the terms and conditions shall continue to have full force and effect as if the invalidated term was not present.
Should any delay or failure to comply with our obligations under these terms and conditions arise where it is beyond our reasonable control, we will not be responsible to you for such delay or failure nor liable for any loss that you incur, howsoever caused.
You will not resell any goods or offer any goods for resale in any country.
We undertake to exercise all reasonable precautions to keep information supplied to us by customers strictly confidential. We do not supply our ‘mailing information’ to third parties but we do use it to advise our clients of goods and services we feel may be of interest to them, unless expressly instructed otherwise in writing. Information supplied to us may be stored on a computer system for our convenience, but will not be supplied to any outside agency. We prefer you to use the secure transaction services to make credit card transactions since this service is completely independent of our organisation and your credit card details are not divulged to us at any time. Applicable Law and Courts of Jurisdiction: All transactions undertaken through this website are governed by English Law and any legal actions arising out of such transactions shall be subject to the English Legal processes and under the jurisdiction of English Courts.
